These Terms set out the rules for using the HOLD KLIM sp. z o.o. website, including the contact form and the air conditioner power calculator. Using the website is free of charge.

1. General provisions

  1. These Terms are issued under Article 8 of the Polish Act of 18 July 2002 on Providing Services by Electronic Means (ustawa o świadczeniu usług drogą elektroniczną).
  2. The service provider and owner of the website is HOLD KLIM SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ (a Polish limited liability company) with its registered office in Toruń, ul. Władysława Łokietka 5, 87-100 Toruń, Poland, entered in the Register of Entrepreneurs of the National Court Register (KRS) maintained by the District Court in Toruń, 7th Commercial Division of the National Court Register, under number 0001257872, tax identification number (NIP) 879-277-88-76, REGON 545370835, share capital PLN 5,000.00 (the “Provider”).

  4. These Terms are made available free of charge on the website in a way that allows them to be obtained, reproduced and recorded, e.g. by printing or saving them.

2. Definitions

Website
the Provider’s website on which these Terms are published.
User
any person using the Website.
Consumer
a User who is a natural person using the Website for purposes not directly related to their business or profession (Article 221 of the Polish Civil Code).
Services
the services provided by electronic means by the Provider through the Website, described in section 3.

3. Types and scope of Services

  1. Through the Website, the Provider offers the following Services free of charge:
    1. access to the content published on the Website, including information about the Provider’s business;
    2. a contact form for sending an enquiry to the Provider;
    3. an air conditioner power calculator for an indicative estimate of a unit’s cooling capacity.
  2. The agreement for the content access Service is concluded when the Website is opened and terminates when the User leaves it.
  3. The agreement for the contact form Service is concluded when the User starts filling in the form and terminates when the message is sent or the User decides not to send it.
  4. The agreement for the calculator Service is concluded when the User starts using the calculator and terminates when the User stops using it.
  5. The User may stop using the Services at any time by leaving the Website or stopping use of the relevant feature.

4. Technical requirements

  1. To use the Website you need:
    1. a device with internet access (computer, tablet or smartphone);
    2. an up-to-date web browser with JavaScript and local storage (localStorage) enabled;
    3. for the contact form – an active e-mail address.
  2. Disabling JavaScript or local storage may prevent the calculator or the contact form from working, or prevent your cookie settings from being remembered.

5. Risks associated with electronic services

  1. Using services provided by electronic means involves general internet risks such as malware, phishing attempts, interception of data transmission or unauthorised access to a device.
  2. The Provider uses an encrypted connection (HTTPS) and the safeguards offered by its hosting provider. To reduce the risk, we recommend using up-to-date software and antivirus protection, and being careful with messages that impersonate the Provider.
  3. The Provider never asks for passwords or payment card details through the Website or by e-mail.

6. Rules for using the Website

  1. The User must use the Website in accordance with the law, these Terms and good practice.
  2. Users must not provide unlawful content, including content that infringes personal rights or intellectual property rights of third parties, or send unsolicited commercial information.
  3. Users must not take any action that could disrupt the Website, including attempts at unauthorised access, overloading the infrastructure or automated form submissions.

7. Contact form

  1. In the contact form the User provides their full name, e-mail address, type of building, the service of interest and a message; company name and phone number are optional. Sending the form requires confirming that the User has read the Privacy Policy.
  2. The message is delivered to the Provider through a server function. If server-side sending is unavailable, the form opens the User’s e-mail program with the message prefilled, which the User can send themselves.
  3. Users should provide true data relating to themselves. Sending an enquiry does not mean that a contract for any work has been concluded.

8. Air conditioner power calculator

  1. The calculator runs entirely in the User’s browser. The values entered are not sent to the Provider or stored.
  2. The calculator result is indicative only and is based on simplified assumptions. It does not take into account all factors affecting cooling demand, such as the insulation of walls, the type of glazing or internal heat sources.
  3. The final choice of equipment is made after an on-site assessment of the property. The calculator result is neither an offer nor technical advice.

9. Nature of the information on the Website

  1. The content of the Website is for information purposes and does not constitute an offer within the meaning of Article 66 of the Polish Civil Code. It is an invitation to enter into negotiations within the meaning of Article 71 of the Polish Civil Code.
  2. Contracts for the selection, installation or servicing of air conditioning systems are concluded separately, on terms agreed by the parties. The Website does not allow such contracts to be concluded or payments to be made.

10. Complaints

  1. Complaints about the operation of the Website and the Services provided through it can be sent by e-mail to [email protected] or in writing to the Provider’s registered office.
  2. A complaint should include the User’s contact details and a description of the problem. If the information provided is not sufficient to handle the complaint, the Provider may ask for more details.
  3. The Provider handles complaints within 14 days of receipt and sends its reply to the e-mail or postal address indicated by the User.
  4. Complaints concerning work performed under separate contracts are handled in accordance with those contracts and the applicable law.

11. Out-of-court dispute resolution

  1. Consumers may use out-of-court complaint and redress procedures, in particular:
    1. seek free assistance from a municipal or district consumer ombudsman (miejski lub powiatowy rzecznik konsumentów) or a non-governmental organisation whose statutory tasks include consumer protection;
    2. apply to the regional inspector of the Trade Inspection (Inspekcja Handlowa) for mediation, or to a permanent consumer arbitration court operating at the Trade Inspection;
    3. in cross-border disputes – seek assistance from the European Consumer Centre.
  2. Information about out-of-court consumer dispute resolution is available on the website of the Office of Competition and Consumer Protection (UOKiK): uokik.gov.pl.
  3. Participation in out-of-court procedures is voluntary for both parties.

12. Intellectual property and illustrations

  1. The content of the Website, including texts, the logo, graphic elements and illustrations, belongs to the Provider or is used by it lawfully. Copying, distributing or modifying it for purposes other than personal use requires the Provider’s prior consent, except where permitted by law.
  2. The illustrations on the Website are visualisations generated with artificial intelligence tools. They are illustrative only and do not show completed work, specific properties or the Provider’s staff.

13. Liability

  1. The Provider makes efforts to ensure that the Website works properly and that its information is up to date and accurate. The Provider may temporarily restrict access to the Website due to technical work or a failure on the part of its service providers.
  2. To the extent permitted by law, the Provider is not liable for the consequences of decisions made solely on the basis of general information on the Website or the calculator result.
  3. Nothing in this section excludes or limits the Provider’s liability towards Consumers where such exclusion or limitation is not permitted by mandatory provisions of law.

14. Personal data and cookies

The processing of personal data is described in the Privacy Policy, and the use of cookies in the Cookie Policy.

15. Final provisions

  1. Matters not covered by these Terms are governed by Polish law, in particular the Civil Code, the Act on Providing Services by Electronic Means and the Consumer Rights Act (ustawa o prawach konsumenta). The choice of Polish law does not deprive Consumers of the protection afforded to them by mandatory provisions of the law of the country of their habitual residence.
  2. The Provider may amend these Terms for valid reasons, in particular changes in the law, the scope of the Services or technical solutions. The amended Terms will be published on the Website at least 7 days before the changes take effect, together with the date from which they apply.
  3. These Terms apply from 16 September 2026.
